US copyright law is absolutely confounding. I think what it the defining factor here is if this image went through the paperwork for American copyright. I believe then the status is out of copyright by two years. Notice the test for a work that is in compliance with US Formalities that was in copyright in it's home country as of Jan. 1, 1996 is under copyright for 95 years after publication date.
