Per the Rosie the Riveter Memorial (http://www.rosietheriveter.org/faq.htm) regarding the image. Given that its a commissioned work by the United States War Production Commission, I'd say that its likely to be in the public domain. I wouldn't worry about it.
4. Is the Rosie the Riveter image copyrighted?
The image that has become most widely known was commissioned by the United States War Production Commission - Co-coordinating Committee for use on a recruiting poster in 1943. It was intended to be displayed for only two weeks, February 15 through February 28. The artist was J. Howard Miller. It is widely held that this image is in the public domain, but we are aware of no official documentation to that effect. There are less well-known images, including a painting by Norman Rockwell entitled "Rosie the Riveter," that remain under copyright.

I have no idea of the legal status of the photo, I believe the length of
time for copyright in the USA is 75 years (unless your Disney, then it
is for ever), thus it still may be covered on this side of the pond. I
think we need to clarify this before printing up a bunch of shirts with
this photo.
Edward - who doubts anyone will be chasing after code4lib but still, we
should do things "the right way"
